Tulisan berikut ini merupakan tugas kampus saya, mata kuliah Regulasi dan Deregulasi Sektor Publik. Saya mendapat bagian untuk mereviu artikel dari jurnal Safety Science berjudul How Deregulation Can Become Overregulation, An Empirical Study Into The Growth Of Internal Bureaucracy When Governments Take A Step Back. Artikel tersebut merupakan hasil kolaborasi dari Kristine Størkersen, Trine Thorvaldsen, Trond Kongsvik, Sidney Dekker.

Studi ini mengeksplorasi bagaimana deregulasi pemerintah dapat menyebabkan over regulasi industri dalam sistem  manajemen keselamatan. Kasus-kasus yang dianalisis adalah dari industri kargo pesisir dan budidaya ikan Norwegia, yang  memiliki otoritas pengawasan, struktur organisasi, profit, dan tradisi yang berbeda.

Ditemukan bahwa over regulasi adalah hasil dari mekanisme organisasi seperti auditable work,  ketidakamanan dan tanggung jawab manajerial, dan praktik audit. Penulis menyimpulkan bahwa overregulasi dapat terjadi bahkan pada sebuah industri dengan langkah deregulasi dan bahwa faktor  organisasi seperti kurangnya kepercayaan, kompleksitas sistem manajemen keselamatan, dan tekanan dari auditor  eksternal dapat menyebabkan overregulasi.

Studi ini mengidentifikasi beberapa contoh spesifik tentang over regulasi dalam sistem manajemen keselamatan di  industri kargo pesisir dan budidaya ikan Norwegia yang menjadi lokus riset. Hal tersebut di antaranya:

  1. Persyaratan dokumen dan dokumentasi yang berlebihan yang menimbulkan beban birokrasi bagi karyawan dan manajer.
  2. Regulasi yang terlalu preskriptif yang tidak memungkinkan adanya fleksibilitas atau adaptasi terhadap keadaan yang  berubah.
  3. Duplikasi upaya antara badan pengatur yang berbeda, menyebabkan kebingungan dan inefisiensi.
  4. Fokus pada kepatuhan daripada manajemen risiko, yang dapat menyebabkan mentalitas “kotak centang” di antara  karyawan dan manajer.
  5. Tekanan dari auditor eksternal untuk mematuhi standar atau praktik tertentu, bahkan jika standar atau praktik  tersebut tidak relevan atau tidak efektif dalam konteks tertentu.

Contoh-contoh ini mengilustrasikan bagaimana langkah-langkah deregulasi kadang-kadang dapat menyebabkan konsekuensi  yang tidak diinginkan, seperti peningkatan birokrasi dan overregulasi, ketika mereka berinteraksi dengan faktor  organisasi lainnya. Para penulis berpendapat bahwa penting untuk mempertimbangkan faktor-faktor ini ketika merancang  sistem dan peraturan manajemen keselamatan untuk menghindari pengaturan yang berlebihan dan mempromosikan praktik  manajemen risiko yang efektif.

Dalam merancang penelitiannya, para penulis menggunakan pendekatan analisis konten kualitatif untuk menganalisis data  dari  wawancara semi-terstruktur dengan 30 karyawan dari 15 perusahaan di industri kargo pesisir dan budidaya ikan.  Dengan metodologi kajian empiris, studi ini  mengeksplorasi alasan over regulasi dan mengidentifikasi faktor-faktor  yang berkontribusi terhadapnya. Penulis mengumpulkan data melalui wawancara, observasi, dan analisis dokumen. Mereka  juga menggunakan kerangka teoritis berdasarkan teori regulasi, teori organisasi, dan literatur manajemen keselamatan  untuk menganalisis data.

Pendekatan analitis yang digunakan dalam penelitian ini memungkinkan eksplorasi pertanyaan penelitian secara mendalam. Namun, karena penelitian ini tidak menggunakan analisis statistik, tidak ada kekurangan dalam analisis statistik yang  perlu diperhatikan. Sebaliknya, peneliti dapat mempertimbangkan untuk menggunakan metode kuantitatif seperti survei  atau eksperimen untuk melengkapi data kualitatif dan memberikan analisis yang lebih tepat.

Misalnya, para penulis dapat menggunakan analisis regresi untuk mengidentifikasi faktor-faktor yang berkontribusi  paling signifikan terhadap over regulasi dalam industri ini. Selain itu, peneliti dapat menggunakan uji statistik  seperti uji chi-kuadrat atau t untuk membandingkan berbagai kelompok perusahaan atau karyawan dan mengidentifikasi  perbedaan yang signifikan di antara mereka.

Sementara, ukuran sampel yang dipakai mungkin sesuai untuk studi kualitatif, sehingga tidak cukup besar untuk membuat  generalisasi tentang seluruh populasi industri ini. Oleh karena itu, sampel yang digunakan dalam penelitian ini  mungkin tidak mewakili semua perusahaan di industri tersebut.

Untuk mengatasi masalah ini, peneliti dapat mempertimbangkan untuk meningkatkan ukuran sampel dan menyertakan lebih  banyak perusahaan dari berbagai wilayah atau negara. Mereka juga dapat menggunakan teknik pengambilan sampel acak  untuk memastikan bahwa sampel mewakili populasi. Selain itu, peneliti dapat menggunakan pendekatan metode campuran  yang menggabungkan metode pengumpulan data kualitatif dan kuantitatif untuk memberikan pemahaman yang lebih  komprehensif tentang masalah penelitian.

Riset ini juga berkontribusi pada pengetahuan baru dan mengisi kesenjangan pengetahuan di bidang manajemen dan  regulasi keselamatan. Studi ini mengeksplorasi alasan over regulasi dalam industri kargo pesisir dan peternakan ikan  Norwegia, yang belum pernah dipelajari secara ekstensif sebelumnya. Penulis mengidentifikasi faktor-faktor yang  berkontribusi terhadap overregulasi, seperti kurangnya kepercayaan antara karyawan dan manajer, kompleksitas sistem  manajemen keselamatan, dan tekanan dari auditor eksternal.

Studi ini juga menantang pemahaman yang ada dengan menunjukkan bahwa sistem manajemen keselamatan yang digerakkan oleh  tindakan deregulasi dapat menyebabkan overregulasi. Temuan ini bertentangan dengan asumsi bahwa deregulasi selalu  mengarah pada berkurangnya regulasi dan menyoroti pentingnya mempertimbangkan faktor organisasi saat merancang sistem  manajemen keselamatan.

Overall, penelitian ini memberikan wawasan berharga ke dalam hubungan kompleks antara regulasi, manajemen keselamatan,  dan dinamika organisasi. Ini berkontribusi pada pemahaman yang lebih baik tentang bagaimana overregulasi dapat terjadi  bahkan di industri dengan langkah-langkah deregulasi dan memberikan rekomendasi untuk meningkatkan praktik manajemen  keselamatan.

Terdapat beberapa kelemahan dalam riset yang sekaligus menjadi keterbatasan studi yang meliputi, ukuran sampel  terbatas dengan sampel 30 karyawan dari 15 perusahaan di industri kargo pesisir dan budidaya ikan Norwegia, yang  mungkin tidak mewakili semua perusahaan di industri ini. Kecondongan data yang negatif, studi ini hanya memasukkan  refleksi narasumber seputar overregulasi.

Sehingga hanya data atau informasi yang negatif yang dimasukkan. Dalam artian hanya mempertimbangkan pendapat  narasumber yang berkaitan dengan overregulasi, yang merupakan istilah negatif yang terkait dengan manajemen  keselamatan dalam konteks overregulasi. Oleh karena itu, materi atau konten dalam studi tersebut memiliki kecenderungan  negatif, dan pengalaman positif dengan manajemen keselamatan diabaikan atau tidak dipertimbangkan.

Dengan analisis subyektif dan interpretatif seperti itu, bisa jadi peneliti lain mungkin akan sampai pada kesimpulan  yang berbeda berdasarkan data yang sama. Keterbatasan ini menunjukkan bahwa temuan penelitian harus ditafsirkan dengan  hati-hati dan mungkin tidak berlaku untuk konteks atau industri lain. Namun, saya rasa studi mereka  memberikan wawasan yang berharga ke dalam interaksi kompleks antara deregulasi, sistem manajemen keselamatan, dan  perilaku organisasi, dan penelitian lebih lanjut diperlukan untuk mengeksplorasi masalah ini secara lebih rinci.

Selain itu kelemahan selanjutnya ialah kurangnya generalisasi. Studi ini berfokus pada dua industri tertentu di  Norwegia dan mungkin tidak dapat digeneralisasikan ke industri atau negara lain. Kemudian kemungkinan adanya potensi  bias, para penulis mengakui bahwa latar belakang dan perspektif mereka sendiri mungkin telah memengaruhi proses  pengumpulan dan analisis data.

Cakupan terbatas, studi ini hanya mengeksplorasi alasan overregulasi dalam industri kargo pesisir dan budidaya ikan  Norwegia dan tidak mempertimbangkan faktor lain yang dapat menyebabkan overregulasi dalam konteks yang berbeda.

Dalam penelitian ini juga, belum ada jawaban khusus yang diberikan tentang bagaimana organisasi dapat mencapai  keseimbangan antara mematuhi peraturan manajemen keselamatan dan menghindari over regulasi. Namun, disarankan agar  organisasi perlu menerapkan sistem manajemen keselamatan yang sesuai untuk operasi mereka dan menghindari prosedur  yang berlebihan, kekacauan keselamatan, dan prosedur yang tidak melayani keselamatan. Studi semacam ini juga perlu  menyoroti pentingnya menganalisis data empiris dari industri yang berbeda untuk memahami hubungan paradoks antara  langkah-langkah deregulasi pemerintah dan overregulasi organisasi.

Namun dengan segala keterbatasan yang ada, penelitian ini memberikan wawasan yang berharga tentang fenomena  overregulasi, keterbatasannya harus diperhitungkan saat menginterpretasikan hasil dan menerapkannya pada konteks lain.

Kesimpulan penulis konsisten dengan temuan penelitian mereka dan didukung oleh kutipan dari narasumber yang  mengilustrasikan pola yang teridentifikasi melalui analisis isi. Penulis juga memberikan rekomendasi untuk  meningkatkan praktik manajemen keselamatan berdasarkan temuan mereka.

Tidak ada inkonsistensi antara temuan penelitian dan kesimpulan yang ditarik oleh penulis. Studi ini memberikan  pemahaman yang komprehensif tentang fenomena over regulasi dalam industri kargo pesisir dan budidaya ikan Norwegia,  yang dapat menginformasikan penelitian dan keputusan kebijakan di masa depan di bidang ini.

Gaya penulisan riset ini bersifat akademik dan teknis. Penulis menggunakan nada formal dan menggunakan terminologi  khusus yang berkaitan dengan manajemen keselamatan, regulasi, dan perilaku organisasi.

Pertama, penelitian menunjukkan bahwa deregulasi dapat memiliki konsekuensi yang tidak diinginkan, seperti  overregulasi, ketika berinteraksi dengan faktor organisasi lainnya. Oleh karena itu, pembuat kebijakan dan regulator  harus mempertimbangkan dengan hati-hati potensi dampak tindakan deregulasi pada sistem manajemen keselamatan dan  praktik organisasi lainnya sebelum menerapkannya.

Kedua, studi ini menyoroti pentingnya pendekatan berbasis risiko untuk manajemen keselamatan, yang menekankan  identifikasi dan mitigasi risiko tertentu daripada kepatuhan terhadap peraturan yang bersifat preskriptif. Pembuat  kebijakan dan regulator harus mempertimbangkan untuk mengadopsi pendekatan ini dalam kerangka peraturan mereka untuk  mempromosikan praktik manajemen risiko yang lebih efektif.

Ketiga, studi ini menekankan pentingnya budaya organisasi dan faktor manusia dalam sistem manajemen keselamatan.  Pembuat kebijakan dan regulator harus mempertimbangkan bagaimana kerangka peraturan mereka dapat mempromosikan budaya  keselamatan dalam organisasi dan mendorong karyawan untuk melaporkan masalah keselamatan tanpa takut akan pembalasan.

Pada intinya, bahwa pembuat kebijakan dan regulator harus mengambil pendekatan holistik untuk manajemen keselamatan  yang mempertimbangkan persyaratan peraturan dan faktor organisasi. Dengan demikian, mereka dapat mempromosikan praktik  manajemen risiko yang lebih efektif sambil menghindari konsekuensi yang tidak diinginkan seperti regulasi yang  berlebihan.
